Need to make a claim?
When making a claim to council, there are two options available:
Option 1
Make a claim through your own insurance policy (for property damage or motor vehicle claims)
You may choose to lodge a claim with your own insurer. Your insurer may then consider seeking recovery against Council where they believe Council is legally liable.
Please note:
- This option may require you to pay an upfront excess to your insurer.
- In some circumstances, if your insurer successfully recovers costs from Council, your excess may be waived.
You should discuss this process with your insurer before deciding how to proceed.
Option 2
Make a claim directly to Council (for personal injury, property damage or motor vehicle claims)
If you are seeking compensation directly from Council for injury, loss or damage arising from an incident, please submit the relevant Insurance Claim Form.
All claims must include, as soon as practicable following the incident:
- Full details of the incident;
- Details of the alleged negligence;
- Photographs of the damage; and
- Two quotations for repair or replacement (where applicable).
You may be required to provide additional supporting documentation to assist with the assessment of your claim.
Completion and acceptance of the Insurance Claim Form does not represent an admission of liability or a waiver of Council’s rights.
Whilst all liability claims will be considered on their individual merits, the following types of claims are generally not successful:
- Damage to tyres or rims resulting from normal wear and tear.
- Damage caused by debris where it occurs during the normal course of driving.
- Damage resulting from criminal actions.
- Damage resulting from extreme weather events.
- Matters that are already the subject of an insurance claim.
- Damage resulting from the actions of a third party.
- Damage resulting in general property damage (for example, panel damage or windscreen damage from vegetation).
What happens now?
Council has an independent insurance company that manages and assesses all claims made to Council. Council’s role is to collate the information submitted and forward it to our insurer for investigation and decision‑making.
Once your claim has been submitted:
- Council will review the information provided and refer the matter to its insurer for investigation to determine whether Council has any legal liability.
- Each claim is assessed individually on its own merits, based on the information provided and the outcome of the insurer’s investigation.
- Additional information may be requested if required to progress the assessment.
Completion and acceptance of the Online Insurance Claim Form does not represent an admission of liability or a waiver of Council’s rights. Council reserves the right to recover any costs that have been unnecessarily or unreasonably incurred in successfully defending claims.
